Terms of Service

These Terms of Service (“Terms”) are an agreement between you and MyCarFly (“we”, “us”) covering your use of this site and the video generator on it (the “Service”). By using the Service or buying a pack, you accept these Terms.

If you don't agree with these Terms, just stop using the Service.

You need an account to use the generator and to buy a pack — the account is where the pack, the renders and the downloads live. You must be at least 16 (or the age of digital consent where you live) to use the Service.

• Give us accurate registration and billing information, and keep it current.
• Keep your sign-in details to yourself — you're responsible for what happens under your account.
• Tell us right away at support@mycarfly.com if you suspect someone else is using your account.

Packs are one-time purchases: you pay once, you get videos to make, and nothing renews or charges on its own. The price is shown before you pay. Card payments are processed by our payment provider — we never see or store your card number.

Refunds. Every order has a 7-day refund: ask us within 7 days of paying, made your video or not, and we'll refund that purchase. Tell us what went wrong if you'd like — that feedback is how the tool gets better for the next person. Refunds go back to the original payment method, usually within 5 to 10 business days. Once an order is refunded, its download links stop working and any re-renders that came with it end. A render that fails is separate: it never counts against your pack, and the generation goes straight back to you. Nothing in this section limits refund rights you have under consumer law.

Prices exclude taxes where they apply; taxes are added at checkout where we're required to collect them.

The generator is for making fun, personal videos. To keep it that way, you agree not to create, upload, request or share content that:

• Sexual or NSFW content. No pornography, explicit nudity or sexual material.
• Violence or gore. No graphic violence, blood or gore, and nothing that celebrates or encourages harm to people or animals.
• Hate speech or harassment. Nothing that attacks, demeans or threatens people for who they are, and no bullying or harassing anyone.
• Sexual content involving minors. Zero tolerance: this is child sexual abuse material (CSAM), and we remove it and report it to the authorities.
• Deepfakes and impersonation. No fake or manipulated videos of real people made without their consent, and nothing that makes someone appear to say or do what they didn't.
• Copyright or trademark infringement. No music, footage, photos, artwork, logos or brand names used without the right to use them.

And a few practical rules to go with those:

• Upload only photos you have the right to use, and only photos of people who've agreed to appear in the video. If someone's photo turns up here without their consent, we take it down.
• Don't break, overload, probe or scrape the Service, or try to get around its limits.
• Don't resell the Service or raw generation capacity.

Reporting content. If you see a video, a photo or an account that breaks these rules, write to us at support@mycarfly.com. A link or a short description of what you saw is enough. We read every report and act on it.

Response times. We acknowledge every report within 2 business days and remove violating content within 5 business days.

How content is reviewed. Every generation runs under an account, and every finished video stays linked to the account that made it, so anything reported can be traced and taken down. Our AI provider also applies its own acceptable-use policies, and we can stop any run that breaks ours.

Enforcement. When these rules are broken we may remove content, refuse or cancel requests, warn or suspend the account, or close it. Illegal content, especially anything sexual involving minors, is reported to the relevant authorities. Where we can, we'll tell you why we acted.

Your photo stays yours, and so does your video. You keep all rights to the photo you upload, and — as between you and us — the generated video is yours. Post it anywhere, including commercial accounts. We claim no rights to your content beyond what's needed to run the Service: processing, storing and delivering it.

We don't train AI models on your photos or videos. Because AI generation is probabilistic, results vary — faces, pets and small details can come out differently from what you expect, so watch your video before posting it. And a small ask: many platforms want AI content labeled, so we recommend tagging it.

MyCarFly is an independent creative tool. It isn't affiliated with, endorsed by, sponsored by or connected to Tesla, Inc., SpaceX or Elon Musk. Every video on this site is generated, and none of it is footage of a real event.

The site and everything we've built around it — the design, the brand, the code — belong to us or our partners, and are protected by intellectual property law. You get a limited, personal right to use the Service as described here; please don't copy it, resell it, or use our name in a way that suggests an endorsement you don't have. If you send us feedback, we're free to use it without obligation.

The Service is built on third-party pieces: our payment provider handles checkout, our email provider sends service emails, our AI processing partner runs the generation on ByteDance's Seedance model, our hosting providers serve the site, and Microsoft Clarity records masked session replays so we can see how pages are used. Checkout in particular happens on our payment provider's pages, where their own terms also apply. We choose these providers carefully and require them to handle your data consistently with our Privacy Policy — but we're not responsible for their own services.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND ANY WARRANTY THAT OUTPUT WILL BE ACCURATE OR ERROR-FREE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE OR DATA; AND OUR AGGREGATE LIABILITY UNDER THESE TERMS IS CAPPED AT THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR US $100 IF YOU PAID NOTHING). THESE LIMITS DO NOT APPLY WHERE THEY CANNOT LAWFULLY BE LIMITED.

You can stop using the Service at any time, and ask us to delete your account. We may suspend or end access if someone seriously or repeatedly breaks these rules, or where the law requires it — where practical, we'll tell you first. If we ever shut the Service down, we'll say so on the site in advance, and refund anything you've paid for but not used.

These Terms are governed by the laws of the country where our team is established, and its courts have jurisdiction — if you're a consumer, you keep the protections of your own country's law. If any part of these Terms turns out to be unenforceable, the rest stays in effect.

We'll update these Terms when things change — material changes get posted here and emailed to account holders before they take effect. Continued use after a change means you accept the new version. Questions? support@mycarfly.com.
